Eyeconic Visuals Media Photography Session Terms and Conditions
By booking a session with Eyeconic Visuals Media, you agree to the following terms and conditions.
1. Entire Agreement
This agreement contains the entire understanding between Eyeconic Visuals Media and the client. It supersedes all prior and simultaneous agreements. The only way to add or change this agreement is to do so in writing, and it must be signed by all relevant parties.
2. Retainer and Payment
A 50% non-refundable retainer fee is required to book and hold your session date. This retainer fee is applied to your chosen session package. The remaining balance must be paid in full prior to the start of the session. Eyeconic Visuals Media will not edit or deliver any images until all payments have been made in full.
3. Rescheduling, Cancellations, and No-Shows
- Clients may reschedule their session one time with at least 48 hours' notice at no additional charge.
- Any additional rescheduling will require a new retainer fee to secure the new date.
- If a client cancels their session entirely or does not show up, the retainer fee will be forfeited, and no rescheduling will be permitted.
4. Force Majeure
If Eyeconic Visuals Media or its assigns cannot perform this agreement due to circumstances beyond their control, including but not limited to acts of God, emergencies, weather, or travel shutdowns, they shall return any fees paid but shall have no further liability concerning this agreement. This limitation of liability shall also apply if photographic materials are damaged without fault on Eyeconic Visuals Media’s part.
5. Re-Shoots
Re-shoots are granted solely at the discretion of Eyeconic Visuals Media. Re-shoots will not be given for poor choices of clothing, make-up, hair, weather-related issues, or by not following recommendations of the photographer. Agreed-upon re-shoots must be rescheduled within 30 days.
6. Pricing and Payment Forms
All prices are subject to change at the discretion of **Eyeconic Visuals Media**. The pricing at the time of booking will be honored, but future bookings will be subject to any new pricing. Payment is accepted via cash or credit. Please note there is a 6% tax rate that will be associated with the final price.
7. Session Timing and Tardiness
Your session begins at the scheduled time. Late arrivals will result in a shorter session. If you are over 25 minutes late without notifying Eyeconic Visuals Media, the session will be canceled without a refund.
8. Safety
Eyeconic Visuals Media reserves the right to end a session immediately due to any behavior deemed threatening, offensive, or posing a risk to the safety of the photographer or equipment.
9. Liability
Eyeconic Visuals Media is not responsible for any injuries inflicted upon any participating parties or any lost, stolen, or damaged property during the session. Clients will be responsible for themselves and their children and release the photographer from any claims against their person or business.
10. Permits and Fees
If a location requires a fee or permit, it will be the responsibility of the client to arrange for those fees or permits prior to the scheduled session.
11. Exclusive Photographer
Eyeconic Visuals Media shall be the sole photographer at the session. No other professional or amateur photographers, including family members or friends, are permitted during the session.
12. Custom Setup
If a custom setup is requested, there may be an additional charge for the request. Any props or items not provided by Eyeconic Visuals Media will need to be brought by the client and arranged within the session time.
13. Photo Delivery
Eyeconic Visuals Media will only deliver final, edited images to clients. RAW or unedited images will not be delivered under any circumstances.
14. Rush Services
Rush editing is available for an additional fee, depending on the complexity of the editing and the required time frame.
15. Final Images
Final images will only be provided after all outstanding payments, including any additional fees for add-ons or extra requests, are settled in full.
